SECTION 13 — MOBILE MESSAGING PROGRAM

The Nouvelle / Silk95Five mobile messaging program (the “Mobile Messaging Program”) is operated by Nouvelle Resort, LLC.

By opting in to the Mobile Messaging Program, you agree to receive recurring SMS, RCS, and/or other mobile messages from or on behalf of Nouvelle / Silk95Five at the mobile number you provided.

Messages may include marketing and promotional communications, product announcements, new arrivals, special offers, early access opportunities, back-in-stock notifications, cart reminders, and, where applicable, transactional or service-related communications.

Consent to receive marketing messages is voluntary and is not a condition of purchasing any goods or services from Nouvelle / Silk95Five.

Message frequency varies. Message and data rates may apply.

You are responsible for any messaging or data charges imposed by your wireless carrier.

You may opt out of SMS messages at any time by replying STOP to a message. Where available, you may also use an unsubscribe link contained in a message.

After requesting to opt out, you may receive a final confirmation message. Unless otherwise permitted by applicable law, you will no longer receive marketing messages through that mobile messaging program unless you subsequently opt in again.

Mobile carriers are not liable for delayed or undelivered messages.

You agree to provide us with a valid mobile number that you control. If you change or deactivate your mobile number, you should notify us or unsubscribe before doing so.

We may modify, suspend, or discontinue the Mobile Messaging Program or its features at any time, subject to applicable law.

Our collection and use of information in connection with the Mobile Messaging Program is governed by our Privacy Policy.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

SECTION 17 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Nouvelle Resort, LLC and its affiliates, directors, officers, employees, agents, and service providers harmless from claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

SECTION 18 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and severed to the extent necessary.

The remaining provisions will remain in effect.

These Terms remain effective while you use the Services.

We may suspend or terminate access to the Services where reasonably necessary due to a violation of these Terms, unlawful conduct, fraud, security concerns, or other legitimate reasons, subject to applicable law.

Rights and obligations that by their nature should survive termination will continue after termination.

SECTION 20 — ENTIRE AGREEMENT

These Terms, together with the policies and other terms incorporated by reference, constitute the agreement between you and Nouvelle / Silk95Five regarding your use of the Services.

Our failure to exercise or enforce a provision of these Terms does not constitute a waiver of that provision.

Nothing in this Section deprives consumers of protections or rights that cannot lawfully be waived under applicable law.
